1. Acceptance of Terms

By accessing or using diamonds.video ("Service"), operated by Paul Roussel EI ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

diamonds.video provides AI-powered video processing for loose diamonds, transforming raw footage into professional, marketplace-ready videos. The Service includes cloud-based video processing, hosting, and sharing tools available through a subscription.

3. Account Registration

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must provide accurate, current, and complete information during registration.

4. Subscription and Payment

The Service is offered on a subscription basis. By subscribing, you authorize us to charge your payment method on a recurring basis. Prices are listed on our pricing page and may change with 30 days' notice. All fees are non-refundable except as required by law.

  • Subscriptions renew automatically unless cancelled before the renewal date.
  • You may cancel your subscription at any time through the billing portal.
  • Downgrading or cancelling takes effect at the end of the current billing period.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or to process content you do not have rights to.
  • Attempt to reverse-engineer, copy, or redistribute the AI processing technology.
  • Upload malicious files or attempt to compromise the Service's security.
  • Resell access to the Service without our written consent.
  • Artificially inflate analytics or view counts.

6. Intellectual Property

You retain all rights to your uploaded content and to the processed output generated by the Service. We do not claim ownership of your diamond videos, footage, or processed results. By uploading content, you grant us a limited license to process, store, and host it as necessary to provide the Service. We retain all rights to the Service's software, AI models, and technology.

7. Content Hosting and Sharing

Processed videos may be hosted on our CDN and made available via shareable links. You are responsible for the content you share and who you share it with. We may remove content that violates these Terms or applicable law.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI processing results will meet your specific requirements.

9. Limitation of Liability

To the maximum extent permitted by law, Paul Roussel EI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms. This includes any claims from third parties related to content you upload or share through the Service.

11. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

12. Termination

We may suspend or terminate your access to the Service if you violate these Terms. Upon termination, your right to use the Service ceases immediately. You may delete your data at any time through the Service, and it will be removed from our systems promptly. After account termination, we may delete remaining data within a reasonable timeframe.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of France. Any disputes arising from or relating to these Terms or the Service shall be submitted to the exclusive jurisdiction of the courts of Paris, France.

14. Changes to Terms

We may update these Terms at any time. We will notify you of material changes via email or in-app notice. Continued use of the Service after changes constitutes acceptance of the updated Terms.
